Bolingbrook DUI Lawyer

Will County or DuPage — and the License Clock

Two things matter immediately after a Bolingbrook DUI. First, where your case will be heard: most of Bolingbrook is in Will County, so most Bolingbrook DUIs go to the Will County Courthouse, 100 W. Jefferson Street, Joliet (12th Judicial Circuit), while the DuPage portion of town is heard in Wheaton (18th Circuit). Your citation lists the county. Second, the license clock: the Statutory Summary Suspension automatically suspends your driving privileges on the 46th day after arrest, separate from the criminal case, and you have a strict, limited window to challenge it. Both clocks start now.

Where Your Bolingbrook DUI Is Heard

As a former Will County prosecutor, the Joliet courthouse — where most Bolingbrook DUIs land — is where I practice and where I know how DUI calls move, who handles them, and where the State’s evidence tends to be vulnerable. For the DuPage-side cases, I bring the same approach to Wheaton.

Weber Road and Boughton Road Stops

Bolingbrook’s DUI arrests cluster on the Weber Road and Boughton Road corridors near its restaurant and entertainment districts, and on Route 53 and I-55. Every DUI begins with a stop, field sobriety tests, and a breath or blood test — and each of those steps has rules the State has to follow. Was the stop justified? Were the field sobriety tests administered properly? Was the breath instrument certified and the operator trained? Those questions decide cases that look airtight in the report.

First Offense, Felony, and Aggravated DUI

A first DUI is generally a Class A misdemeanor, and court supervision that avoids a conviction is frequently available to first offenders, though never automatically. A DUI is charged as a felony (aggravated DUI) for a third or later offense, driving on a suspended or revoked license, no valid license or insurance, a child passenger, or an accident causing injury. (See DUI Defense and License Reinstatement.)

The Former-Prosecutor Advantage

I prosecuted these cases before I defended them, and that perspective shapes everything from how I read the police reports to how I negotiate with the State. For a Bolingbrook driver whose license and job are on the line, that is the difference between reacting to the case and controlling it. For criminal charges beyond the DUI, see my criminal defense page.
