Bolingbrook Criminal Defense Lawyer

Which Court Hears a Bolingbrook Case — Will County or DuPage?

Bolingbrook is unusual: it straddles two counties. Most of the village lies in Will County, so the majority of Bolingbrook arrests are heard at the Will County Courthouse, 100 W. Jefferson Street in downtown Joliet, in the 12th Judicial Circuit — the court where I practice every week. A portion of Bolingbrook extends into DuPage County, where cases are heard in Wheaton (18th Judicial Circuit). Your citation or bond paperwork lists the county that charged you, and minor matters may pass through the Bolingbrook Branch Court at the village police department before serious cases move to the main courthouse. I represent clients in both counties, and my deepest experience is in the Will County system that most Bolingbrook cases fall under.

Why That Distinction Helps You

The two counties do not run identically. Will County criminal cases are prosecuted by the Will County State’s Attorney’s Office, whereas some DuPage municipalities use village prosecutors — a difference that affects how a case is negotiated. I am a former Will County prosecutor and a former Illinois Assistant Attorney General, so for the majority of Bolingbrook cases — the Will County ones — you are getting a lawyer who learned that exact office and those exact judges from the inside.

The Charges We See Most in Bolingbrook

  • Drug offenses — possession of a controlled substance under 720 ILCS 570/402, cannabis offenses, and paraphernalia. (See Drug Crimes)
  • Domestic battery — 720 ILCS 5/12-3.2, frequently resting on a single account and carrying non-expungeable consequences. (See Domestic Battery)
  • Retail theft — 720 ILCS 5/16-25. (See Retail Theft)
  • Weapons charges under 720 ILCS 5/24-1, and assault, battery, and disorderly conduct.

If your case involves drinking and driving, see my Bolingbrook DUI page — DUI runs on its own track with its own license deadline.

Traffic Stops on Weber Road, Boughton Road, and I-55

A large share of Bolingbrook arrests begin as traffic stops — along the Weber Road and Boughton Road corridors near the village’s restaurant and entertainment districts, on Route 53, and on I-55. When a charge grows out of a stop, whether that stop and any resulting search were lawful is often the first place the case can be challenged.

Why a Former Prosecutor Helps

Knowing the Will County State’s Attorney’s Office from the inside lets me see where a charge is weak, anticipate what the State will offer, and build a defense aimed at the best realistic outcome before trial — trial-ready when it is not. For the Will County cases that make up most of Bolingbrook, that inside view is a genuine advantage, and I bring the same diligence to the DuPage matters I handle.
